The following is the privacy policy (hereinafter, "privacy policy" or "policy") governing the Gymder module within the TRAININGYMapplication (hereinafter, the "Module").

The Module is owned by INTELINOVA SOFTWARE S.L. (hereinafter, "TRAININGYM").

WITH IT WE WANT TO EXPLAIN YOU IN A SIMPLE, CLEAR AND TRANSPARENT WAY HOW WE TREAT AND PROTECT YOUR PERSONAL INFORMATION AND YOUR RIGHTS. YOUR SECURITY AND THE SECURITY OF YOUR PERSONAL DATA IS FUNDAMENTAL TO TRAININGYM AND WE TAKE ITS ADEQUATE PROTECTION VERY SERIOUSLY.

 

WHO DOES THIS POLICY APPLY TO?

This privacy policy applies specifically to all users of the Gymder module within the TRAININGYM application (hereinafter, indistinctly, the "user" or "users") who are considered natural persons. By personal data we mean any information about an identified or identifiable natural person.

In the event that the user is a client of a sports center that uses TRAININGYM's software, he/she must take into account that such center acts as responsible for the data processing that it directly manages within the framework of its services. The present policy only regulates the processing of personal data that TRAININGYM carries out directly in its capacity as data controller, linked to the use of the Gymder module and the functionalities that it makes available to the end users.

During the periods necessary to give due satisfaction to the execution of the contract between the parties (duration of the contract between the parties). Your personal data will be processed for this purpose for as long as you are registered as a Gymder user.

To enable the video and audio functions and the sending of images and video.

We collect and process your data to enable you to use the communication features on Gymder, such as making video calls, audio calls, and sending or receiving images and videos. This includes accessing your camera, microphone and image gallery, always with your consent.

 

This data is handled securely so that you can share multimedia content with other members seamlessly and privately, ensuring that your information is protected while you enjoy these interactive features.

Your personal data will be processed for this purpose until you object to it.

To enable our chat service for your interaction with other users.

We use your data to activate and manage the chat function, allowing you to communicate with other users in real time.

 

This includes processing the messages you send and receive within the application, ensuring that conversations are smooth, secure and private.

Your personal data will be processed for this purpose for as long as you are registered as a Gymder user.

To manage any incident or complaint.

We collect and use your personal data to help you in case you experience a problem with the Module or have a complaint.

 

This includes identifying and resolving technical issues, reviewing reports of inappropriate behavior, and addressing service-related complaints or interactions with other users.

- Personal identification data (name and surname, NIF).

- Personal contact data (personal telephone or cell phone, e-mail).

- Personal data processed as a result of the complaint.

Your consent and, as the case may be, execution of pre-contractual measures at the request of the user/interested party.

For the time necessary to properly address your claims, or, if they consist in the execution of pre-contractual measures or the subscription of a contract with TRAININGYM, for all the time necessary to give due satisfaction to such execution or request.

Sending commercial information.

We will treat your data in order to offer you, by any means of communication, including email, SMS, MMS, or equivalent, commercial information about our products and services.

- Personal contact details (personal telephone or cell phone, email).

 

Your consent, unless the exception provided for in art. 21.2 of Law 34/2002, of July 11, 2002, on services of the information society and electronic commerce, in which case the basis of legitimacy will be the legitimate interest of TRAININGYM.

Your personal data will be processed for this purpose as long as you do not object to it and up to two years after the end of your relationship with TRAININGYM.




When the legitimate basis for the processing of your personal data is your consent, we remind you that you have the right to revoke it at any time simply and free of charge by writing to protecciondatos@intelinovasoftware.com.

With regard to the retention period, in general, when the personal data is no longer necessary for the purposes for which it was collected, it will be blocked, remaining available only to the competent authorities for the possible purge of legal responsibilities during the processing of the same, always in accordance with applicable law, and may not be used for purposes other than these. After the corresponding legal deadlines have passed in case of blocking, your data will be deleted in accordance with the applicable regulations, and may also, if applicable, be securely anonymized by TRAININGYM (anonymized/non-personal data).

WHAT ARE THE CONSEQUENCES OF NOT PROVIDING US WITH YOUR DATA?

We try to request or apply the minimum and essential data to carry out the processing of personal data that we carry out in full development of our object and social purposes. All this in accordance with the principles contained in the applicable regulations.

However, failure to provide your personal data may result in the impossibility to: 1) navigate correctly through our app, 2) process your request or specific request (for example, due to the lack or insufficient completion of the forms provided, 3) impossibility to suggest you to other users and vice versa; 4) restrictions on the use of features (video, audio, images); 5) disabling the chat service.

In any case, the information and personal data you provide must be sufficient, adjusted and limited to what is requested through the app forms; 2) accurate, updated and truthful, in order to adequately verify your identity and be able to access the services of the application.

Users will be fully responsible for the data and personal information they provide to TRAINIGNYM within the framework of the application and, where appropriate, for the services they require or contract.

DO WE SHARE YOUR PERSONAL DATA WITH THIRD PARTIES?

In general, we do not share your data with third parties, nor do we sell or offer it to them. However, as a client of TRAINIGNYM, your personal data may be shared with those collaborating entities, in the manner and for the purposes described in the contracts signed with them and/or with us. For the purposes indicated above, your personal data may be communicated, where appropriate, to the following recipients:

  • To the Public Administrations in the cases provided for in the Law.
  • State Security Forces and Corps.
  • Courts and Tribunals.

Similarly, it is possible that certain third parties may access your personal information in the development of the services they may provide to TRAININGYM. For example, in the case of third party cookies (see cookies policy).

 

ARE YOUR PERSONAL DATA TRANSFERRED INTERNATIONALLY?

We inform you that, in general, international transfers of your personal data are not foreseen, adopting the necessary measures and guarantees by TRAININGYM in this area in accordance with the current regulations on personal data protection. WHAT RIGHTS DO YOU HAVE, WHAT DO THEY MEAN AND HOW CAN YOU EXERCISE THEM?

You can exercise your rights of access, rectification, deletion, portability, limitation of treatment and opposition by email to protecciondatos@intelinovasoftware.com, accompanying, if necessary to prove your identification, a copy of your national identity card or equivalent identification document (passport, N.I.E. ...).

We also inform you that if you do not consider that your personal rights have been duly addressed, you may file a complaint with the competent supervisory authority, in this case, the Spanish Data Protection Agency (AEPD). For more information, please visit the website www.aepd.es.

However, we recommend that before filing any complaint or claim before the AEPD you contact us, in order to analyze the specific situation and try, if necessary, to find an effective and amicable solution.

 

ARE SECURITY AND PROTECTION MEASURES APPLIED TO YOUR PERSONAL DATA?

Taking into account the nature, scope, context and stated purposes of the processing, as well as the risks of varying likelihood and severity to your rights and freedoms, TRAININGYM applies (and will apply) appropriate technical and organizational measures to ensure appropriate security and protection of your personal data by meeting privacy by design and default criteria, as well as applying a system approach to concurrent risk that will be reviewed and updated by TRAININGYM as necessary.

VALIDITY AND MODIFICATION OF THE PRIVACY POLICY

This policy is effective as of October 1, 2025.

TRAININGYM reserves the right to modify this policy, to adapt it to future legislative, doctrinal or jurisprudential developments that may apply, or for technical, operational, commercial, corporate and business reasons, informing you in advance and reasonably of the changes that occur when possible. In any case, it is recommended that, each time you access this application, you read this policy in detail, since any modification will be published through it.
